Lagos pastor in homosexual, serial rape scandal

An alleged self-confessed pastor, Sadeeq Mustapha, is
facing trial at a Lagos State Magistrate Court sitting at Ogba,
Agege where he has been charged with alleged attempt to
rape two men.
Sadeeq (27) allegedly attempted to forcefully have sexual
intercourse with a transporter, Oladimeji Taiwo, and a
teacher, Yusuf Idowu, on October 9 and 10. The incident
allegedly took place at No 9 Disu Akogun Street, Dopemu,
Lagos.
The two-count charge against the suspect read: “That you,
Saseeq Mustapha, on the 9th day of October, 2015 at 9, Disu
Akogun Street, Dopemu, Agege, in the Ikeja Magisterial
District, did conduct yourself in a manner likely to cause the
breach of peace by forcefully wanting to have sex with one
Oladimeji Taiwo ‘m’ and thereby committed an offence
punishable under Section 166 (d) of the Criminal Laws of
Lagos, Nigeria, 2011.
“That you, Sadeeq Mustapha, on the 10th day of October,
2015, at about 02.30hrs, at the same place and magisterial
district, did forcefully wanted to have sex with one Yusuf
Idowu ‘m’ by ordering him to pull off his clothes and
committed an offence punishable under Section 166 (d) of
the Criminal Laws of Lagos, Nigeria, 2011″.
The suspect pleaded not guilty to the charges and was
granted bail in the sum of N200,000 with two sureties in like
sum.
In his statement to the police, Oladimeji, one of the alleged
victims narrated that the defendant met him in Dopemu area
of the state, introduced himself as a pastor and then asked
him for road direction around the area. After directing him,
the alleged victim said the suspect requested to pray for him
and that, since he liked associating with men of God, he took
him (the pastor) to his house where he introduced him to his
fellow tenants as a brother.
Oladimeji explained that they went into prayer session after
the suspect had “blessed a table water he bought” on their
way home, saying the prayer, which started late in the night,
lasted for some time. He alleged that while the prayer lasted,
the suspect ordered him to pull off his trousers and shirt,
which he did. He added that, at a point, he started noticing
some moves by the suspect and, as such, decided not to
close his eyes anymore.
Oladimeji further alleged that the suspect’s mood changed as
he asked him to lie down flat because, according to the
suspect, the level of prayer they were about to go into
required that he (the suspect|) lies on top of the person
receiving the prayer. But that on noticing that the suspect
was about to sleep with him rather than pray for him, he
stood up, directed his gaze at the suspect, who had noticed a
resistance to his intention, and warned him sternly against
the attempt. He said he called off the prayer and sat down
wondering with disbelief the alleged attempt to rape him.
He said that because he didn’t want to disgrace a man who
said he was a man of God and the fact that he had already
introduced him as a brother, he allowed the suspect to go in
the morning, unmolested, but told him never to come to his
house again.
Oladimeji said that after that, he left for work and did not
return till the following morning. Upon his return, the alleged
victim was amazed to still meet the suspect in his house.
This was because the second victim, Yusuf, who only saw
the Sadeeq and his co-tenant the previous night, did not
know what had happened and, as such, had admitted the
suspect into his apartment the second night during which the
defendant allegedly attempted to rape him in the same
manner he tried to rape Oladimeji the previous night.
On sighting the suspect, the latter said he ordered him to
leave the house immediately but that Mustapha refused,
prompting him to pick up a machete to attack him but for the
intervention of neighbors who were later shocked to hear
what the suspect allegedly did to his two victims. Still
reluctant to leave the house, Oladimeji said he called his
uncle, who instructed him to get the suspect arrested, which
he did.

I have confidence in the judiciary, says Governor Wike


Rivers State Governor, Nyesom Ezenwo Wike has declared
that he has absolute confidence and respect for the Judiciary
to do justice in the state governorship legal tussle, pointing
out that based on the April 11 election, his mandate would be
upheld in the course of the Appeal process .
Also, Rivers State Stakeholders on Thursday declared that
they are solidly behind Governor Nyesom Ezenwo Wike who
was duly elected on April 11. The stakeholders included
elected senators, House of Representatives members,
traditional rulers, Elder statesmen and state legislators.
Speaking at the Stakeholders meeting at the Government
House, Port Harcourt, Governor Nyesom Wike advised the
people of the state never to criticise judges despite the
judicial setback, pointing out that the appeal process will
correct the judicial opinion of the state tribunal.
Governor Wike dissociated himself from a statement from
one of his aides describing the tribunal judgment as judicial
terrorism and gang-up. He said the aide had no mandate to
issue such a statement, noting that as a lawyer he respects
the judiciary and knows the appellate process to seek
redress.
“Be assured by the Grace of God our lawyers are working
hard to file the appeal within stipulated time. I have told
people that it is not in our character to cast aspersions on
judges. I have also told people not to speak on my behalf to
castigate judges. The tribunal is not the final appellate court
on this matter. There is no need of castigating the judiciary.
“We are not one of those when judgment favours you, you
says you have confidence in the judiciary. When it does not
favour you, you lose confidence in the judiciary.
“I want to say in the past two days, you must have read
where they quoted me as saying judicial terrorism or judicial
gang-up, I never said so. And I never authorised anybody to
say so on this matter”.
The governor noted that his team of lawyers are working
round the clock to complete the process of filing an appeal
against the judgment.
He assured the people that he is not distracted by the
judgment. The governor said he is emboldened by the
support of key stakeholders and the ordinary people to
continue to discharge his responsibility to the people.
Governor Wike told the stakeholders the Appeal Court
judgment of Thursday striking out the paragraphs of the APC
petition that alleged violence and crime against named and
un-named security agents and political thugs has
strengthened his case that will shortly go on appeal.
In his remarks, Acting National Chairman, Prince Uche
Secondus stated that the people are behind Governor
Nyesom Wike against the struggle by external forces to
invade the state.
Also speaking, Senator George Sekibo said that Governor
Wike was duly elected and his election will be updated in the
course of the course of the appeal.
Former Minister of Transport, Dr Abiye Sekibo, Former UBA
Chairman, Chief Ferdinand Alabrabra and Former NBA
President, Chief OCJ Okocha, on behalf of different sections
of the state declared the overwhelming support of the people
for the governor.

CBN refuses to devalue Naira, plans PAVE


Governor, Central Bank of Nigeria, CBN, Mr.
Goodwin Emefiele has restated that the CBN will not devalue
the Naira anytime soon to revive the falling economy.
He said that the Bank has had to depreciate the currency
from N155 to N197 in February, recalling that even President
Mohammdu Buhari and Vice President Yemi Osinbajo had
also re-echoed the position of the CBN.
Emefiele however stated that the CBN would soon launch a
policy called PAVE meaning “Produce locally, add value and
export your product and earn your foreign exchange for your
imports” to help local industries.
He spoke to State House Correspondents after a meeting on
the economy with the Vice President, Yemi Osinbajo at the
presidential villa on Friday.
He said: “There has been a lot of talk on whether or not we
want to depreciate our currency again.
The truth is that we had adjusted the currency by
depreciating it from N155 to N197 in February this
year.There is no intention to depreciate or adjust the
currency any longer.
“The President has been very clear on this. The Vice
President has been very clear on this and let me further
reiterate our position at the Central Bank of Nigeria that we
are not considering any further depreciation of the currency.
“What we are trying to concentrate on right now is how to
improve and deepen the foreign exchange market by
improving supply of foreign exchange into the market.
And to do so, we are trying to encourage people to export
and earn your export proceeds and use your export proceeds
to import whatever you need to import.
We are also concentrating on how to reduce the import of
items that we can produce in the country today.
“So that is our focus. I’m saying and very soon the CBN will
be launching a campaign called PAVE, which means
“Produce locally, add value and export your product and earn
your foreign exchange for your imports’’ because this is the
only way we can support the efforts of CBN in intervening
and providing foreign exchange in the market to meet the
import needs of our people.
“It is very clear, what we need to do is reduce our propensity
to import but we will not depreciate our currency. For now
we will not.”
The governor also revealed that the CBN was working a list
to exclude a number of items from foreign exchange market.
“First of all, the CBN does not have the power to ban the
import of any item.
What we have done is to exclude certain items that are
imported into the country from obtaining foreign exchange
from the Nigerian foreign exchange market.
“Yes, it is also true we held a stakeholders’ meeting with the
organized private sector and prominent and leading private
sector stakeholder were at that meeting.
“It was not meant for the press. The purpose of that meeting
was to engage the private sector to make the private sector
understand that government realizes that they are engine of
growth and we also used the opportunity to explain to them
the basis and purpose of those policies that we have
introduced and at the end of that meeting they were very
happy, they saw our position and indeed at the end of that
meeting some of them in fact provided us with the names of
some items that should be included in the list that should be
excluded from foreign exchange.
“And I must confess that at this stage given the
determination of some of the organized sectors to say that
yes, they produce these items and that we should exclude
those items from foreign exchange.
We are reviewing that list and we may in due course include
more items products that can be produced in Nigeria in the
list of items that will be excluded from foreign exchange in
the Nigerian foreign exchange market”, he said.
Meanwhile he Naira on Friday depreciated further at the
parallel market amidst intense regulation of the activities of
operators of the Bureau de Change (BDCs) by the Central
Bank of Nigeria (CBN).
The currency lost N0.5 to the dollar as it exchanged for
N226.5, as against its previous value of N226.
The official exchange rate at the interbank window remained
at N197 to the dollar.
Traders at the parallel market attributed the recent
depreciation of the naira to the apex banks further tightening
of the conditions of operation of the BDCs, making more
people to access forex at the parallel market.
They said that the CBN now required operators of the BDCs
to show the name of the person/company buying forex, his
Bank Verification Number (BVN) and his ticket, if he was
travelling. )

The president’s official jet however made a technical stop-
over at the Khartoum International Airport, Sudan, before

Shan George Recounts Experience From Car Accident

Actress Shan George who survived a car crash on Monday, October 26 has revealed her surprise that there were no major injuries from the incident. She spoke on the accident at the Nigerian Broadcasters Merit Awards as she lauded the people at the scene for their timely support at the time of the car crash. The actress was driving to Lagos from Calabar when another car crashed into hers on the Onitsha road, leaving the driver’s side of her white jeep badly damaged. She wasn’t the only one in the vehicle but fortunately they all escaped with no one hurt. She said of the incident: “ Nigerians are really wonderful people, abandoned their businesses as to help out at the accident scene. The traffic department of police in Enugu handled the case very well and we are all good. “ My car is already being fixed as I recuperate from the shock. I’m begging Federal government to fix interstates roads .” On why she had to drive on the day she said: “S ome [people] hate flying. “I vomit whenever I’m in a plane, also, driving is my passion ,” she added.

Cross Rivers State Governor Suspends Prayers In Schools

Cross River state governor, Ben Ayade Governor Ayade in a letter signed by Mrs Anne O. Odey, the permanent secretary, state Ministry of Education, dated Wednesday, October 21, said the suspension of prayers will subsist till further notice, Daily Trust reports. The governor also ordered that all teachers with effect from next year must be in suits during official hours. The directive which was sent to all zonal heads in the state said: “The ministry hereby directs all public and private primary and secondary schools across the state to suspend all assemblies (morning and afternoon) till further notice.” All school heads were directed to comply strictly or risk sanctions. The Christian Association of Nigeria (CAN) in reaction to the new development, signed by Archbishop J. E. Ukpo, the state chairman and Apostle Iwara Oleh Obeten, the state secretary said such directive was completely unacceptable. The christian group said the order would negatively affect the upbringing of children and urged the state government to immediately withdraw the directive. The politician stated this when he spoke with the state house journalists after his meeting with the country leader in Aso Rock. Ayade spoke about his negative attitude towards privatization calling it an “unacceptable” exercise.

BVN Deadline: 26m bank accounts to be frozen

Barely 24 hours to the deadline for Bank Verification Number, BVN, less than half of the 52 million bank customers have been registered, a development that may have caused discomfort in the banking industry. Central Bank of Nigeria, CBN, had said no extension would be made while non-registered bank customers would be barred from accessing their money or any transaction in their account after tomorrow. About 26 million bank customers would be affected by the shut-out. An official of the apex bank told Vanguard yesterday that the registration window would still be opened after tomorrow, but unregistered customers would not be allowed access to their accounts. The official, who claimed that the exact figures of registered bank customers would not be ready until next week, however lamented that “less than half of total bank customers have been captured as at Monday this week. “Field reports show that there has been increased surge in the number of registrations per day since last week, but it is clear that we may not exceed 50 percent by the deadline.” Managing Director, Ecobank Nigeria Plc, Jibril Aku, had said last month that bank customers who fail to meet the October 31 deadline to enroll on the BVN network will have their accounts frozen. Aku, who spoke at the end of the 324th meeting of the bankers’ committee in Lagos, said there was no going back on the new deadline set by CBN for customers to obtain their BVN. He said: “There will be no extension of the October 31 deadline. All efforts have been made by the committee, CBN and Nigeria Interbank Settlement System for bank customers to obtain their BVN. “The customers, who fail to meet the deadline will not be able to operate their accounts until they comply.”

Imo gov poll: S-Court upholds Okorocha’s election lDismisses appeal by Ihedioha, PDP

The Supreme Court, yesterday, affirmed Governor Rochas Okorocha as the winner of the April 11 governorship election in Imo State. The apex court, in a unanimous judgment by a seven-man panel of Justices, dismissed the appeal that was lodged before it by former Deputy Speaker of the House of Representatives and governorship candidate of the Peoples Democratic Party, PDP, in the state, Mr. Emeka Ihedioha. The Supreme Court declined to set-aside two concurrent verdicts of the Imo State Governorship Election Petition Tribunal and the Court of Appeal which earlier declared Okorocha as winner of the gubernatorial poll. Ihedioha had in a petition he filed before the tribunal on May 19, sought the nullification of Okorocha’s election. He had among other things, alleged that the election was fraught with irregularities, insisting that officials of the Independent National Electoral Commission, INEC, rigged the poll in favour of the All Progressives Congress, APC. In the petition marked EPT/IM/GOV/3/2015, which had Okorocha, APC and 36 others as respondents, Ihedioha, told the tribunal that the election was marred by violence, harassment and intimidation of voters. Besides, it was his contention that the election was conducted in substantial non-compliance to the provision of the Electoral Act. He maintained that the election was in violation of Paragraph 28 of INEC’s guidelines for the 2015 election. However, the tribunal, in a judgment it delivered on July 22, dismissed the petition at the preliminary stage. The tribunal led by Justice David Wyom held that the petition was incompetent and lacked merit. The panel upheld argument by Okorocha’s lawyer, Mr. Niyi Akintola, SAN, that the petition should be deemed as abandoned considering that Ihedioha, failed to within seven days, pay mandatory N100 required to kickstart pre-hearing session on his petition as stipulated in Section 18(1) of the Electoral Act, as amended. The tribunal noted that the petitioner applied on June 23, but failed to pay for the pre-hearing notice until June 3, despite the fact that his application was within time. According to the tribunal, “Based on the strength of the Supreme Court authority on this issue, the validity of the process starts from when the pre-hearing notice payment was made and not when it was applied, this in turn means the petitioner paid out of time but applied within time”. Meantime, dissatisfied with the decision of the tribunal, Ihedioha took the matter before the Owerri Division of the Court of Appeal. In a judgment it delivered on September 3, the appellate court panel led by Justice Jimmy Bada affirmed the decision of the tribunal, adding that Ihedioha’s notice of appeal was fundamentally defective. Not happy with the verdict, Ihedioha filed appeal before the Supreme Court wherein he sought for an order setting aside the concurrent decisions of the two lower courts. In the lead judgment that was read yesterday by Justice John Inyang Okoro, the apex court, said the lone issue to be determined in the matter was “Whether there was service on the 2nd-36threspondents; if not, what is the effect”. The apex court relied on Section 318 of the Constitution which deals on “Interpretation, Citation and Commencement” of hearing, to discountenance the appellant’s argument that the registrar of the tribunal had announced to parties that notices of appeal had been duly served on the respondents. According to Justice Okoro, the word “decision” under Section 318 of the CFRN “means, in relation to a court, any determination of that court and includes judgement decree, order, conviction, sentence or recommendation”. “In view of the foregoing, I do not think the registrar’s statement gave any credence to service of notice of appeal. It is trite that notice of appeal is a condition precedent, and there is nothing on record to show that the appellant duly effected service on the respondents. More so, the apex court held that the statement of the registrar that there was service on all respondents did not emanate from the chairman of the tribunal nor was it backed by any evidence. The Supreme Court said it also considered whether the appellant complied with the rules of the Court of Appeal on the issue of filing of notice of appeal. “Where a defendant is not aware of a pending litigation against the defendant, proceeding held in respect of the issue is nullity. “In this instant case, there is evidence that the 2nd-36 respondents were not served with appeal notices and there is no evidence from the Court of Appeal showing that an order of substituted service was made. “Failure to serve notice of appeal on the respondents offends the provision of Order 2 Rule 3 of the Court of Appeal and non filing of notice of appeal is a flagrant abuse of Order 2 Rule 3, and thereby renders it incompetent”, the Supreme Court held. The court further held that the appellant instead of serving the proper parties, dumped the notice of appeal at the office of the APC on July 28, 2015, “whereas there was no order for substituted service”. “Let me categorically state here that the court is not a slave to rules; non compliance with rules guiding the service of notice of appeal and other processes is incurably defective. Rivers gov poll: Appeal Court expunges part of APC’s petition against Wike

Appeal sitting in Abuja, yesterday, expunged some paragraphs of the petition that led to the annulment of the April 11 governorship election that brought Governor Nyesom Wike of Rivers State to power. In a judgment it delivered, a three-man panel of Justices of the Appeal Court headed by Justice Datti Yahaya, struck out portions of the petition alleging that security agents were used to rig the election in favour of Wike and the Peoples Democratic Party, PDP. The decision of the appellate court followed an interlocutory appeal that was lodged before it by the APC and its governorship candidate in Rivers State, Dr. Dakuku Peterside. Both APC and Peterside had gone before the court to challenge the ruling of the previous chairman of the Rivers State Governorship Election Petition Tribunal panel, Justice Muazu Pindiga, which deleted paragraphs of the petition containing criminal allegations against unnamed security operatives. Justice Pindiga, who was subsequently removed from presiding over the petition by the President of the Court of Appeal, Justice Zainab Bulkachuwa, based his decision on the fact that the petitioners failed to join the said security agents and other persons it said participated in the alleged electoral fraud as parties to the suit. Among those that the APC alleged masterminded the rigging of election in Rivers State included wife of former President Goodluck Jonathan, Dame Patience. But, dissatisfied with the ruling of the lower tribunal, the petitioners took the matter before the appellate court. While upholding the decision of the tribunal yesterday, the appeal court held that paragraphs of the petition containing allegations of electoral crime against named and unnamed security agents and alleged political thugs should be expunged from the record of the tribunal. The court stressed that the petitioners ought to have joined the accused security agents and political thugs as parties to the petition. Specifically, the court directed that evidences that were led against security agents and political thugs, whether named or unnamed, in the course of hearing of the petition against Wike, where the said security agents and alleged political thugs were not joined as parties, should be struck out. The Court of Appeal further directed that all the criminal allegations contained in the petition against the said security agents and alleged political thugs be expunged as they had no opportunity to defend themselves at the tribunal. The court held that in cases where criminal allegations were made against institutions, agents and individuals, the law required that in the interest of justice, they should be joined as parties to the matter. Other members of the appeal court panel that delivered the judgment were Justices Tanim Yusuf and Mustapha Mohammed.
